Why was the extradition of the murder accused from Dubai to Pakistan not possible till now?

After the red notice was issued, in January 2023, the UAE authorities requested Pakistan to submit an extradition file for the extradition of the accused/file photo.

In the case of the extradition of the murder accused from Dubai to Pakistan, despite the reminders of the Ministry of Foreign Affairs, the UAE's non-response is normal practice or weak diplomacy?

After waiting for more than a month, on December 8, the accused of the murder of the former Regional Chief of State Life Insurance Muhammad Ahmed Amjad was heard in the Sindh High Court regarding the case of extradition from Dubai to Pakistan. It was expected that the Foreign Ministry of Pakistan would be a comprehensive progress report will be submitted to the court but unfortunately the Ministry of Foreign Affairs had no progress report in this regard and blamed the current delay in the extradition case on the UAE authorities saying that despite reminders for the past two months No response is coming from there.

The extradition case relates to accused Taqi Shah, who currently resides in Dubai and is accused of barging into his own regional chief's office and shooting 10 bullets in 2008 after his attachment request was rejected. was killed and immediately after the murder the accused Taqi Shah fled the country and for 12 years nothing was found about him nor did the state show any interest in providing justice in this case.

The interesting turn in this case came when the daughter of the victim, Mahim Amjad, after 12 years of searching, found out through social media in 2020 that the accused was currently residing in Dubai and informed the Pakistani authorities about this. Later, a red notice was issued against the accused.

After the Red Notice was issued in January 2023, the United Arab Emirates authorities requested Pakistan to submit the extradition file for the extradition of the accused, but since then, when the Ministry of Foreign Affairs of Pakistan has handed over this file to the Dubai authorities. So they returned it as incomplete.

Interestingly, in this case, the ministry which was obliged to submit the certified documents to the Ministry of Foreign Affairs is the Ministry of Interior of Pakistan, which has clearly said that it has completed all the documents in this case and provided them to the Ministry of Foreign Affairs.

From January 2023 to August 2023, when the United Arab Emirates raised objections on the extradition file submitted by Pakistan three times, on September 2023, the Ministry of Foreign Affairs of Pakistan once again dealt with the objections and submitted the extradition file for the extradition of the accused to the Dubai authorities. and since then till today, Dubai authorities have not even responded to Pakistan's Ministry of Foreign Affairs despite reminders.

Yesterday in the Sindh High Court hearing related to the case of extradition of the accused, Gian Chand, the Deputy Chief of Protocol of the Ministry of Foreign Affairs, has taken the stand in his written response submitted to the court that 'Our mission in Abu Dhabi is that of the accused Taqi Shah. He is in daily contact with the Ministry of Foreign Affairs of the United Arab Emirates regarding the progress of the extradition. .

Importantly, the Ministry of Foreign Affairs of Pakistan had submitted a similar reply in the same court on October 23, after which the hearing of the case was adjourned for more than a month and now when the case was heard again yesterday. If so, the Ministry of Foreign Affairs then took the position that it is waiting for a response from the authorities of the United Arab Emirates.

After this response of the Ministry of Foreign Affairs, the court issued its written order and wrote that "It appears that the Ministry of Foreign Affairs of Pakistan has sent 3 reminders to the UAE and has also requested a meeting with the Dubai authorities to discuss this matter." "We once again direct the Ministry of External Affairs to take up the matter expeditiously. If progress is not shown, the Additional Secretary of the Ministry of External Affairs will personally But appear in the next hearing and the hearing of the case is adjourned for 3 weeks'.

That is, the court has asked the Additional Secretary of the Ministry of Foreign Affairs to appear personally in the next hearing if there is no progress in this case.

Importantly, when this correspondent reported on December 4 about the inexplicable delay in the case and raised questions about the capabilities of the Pakistani mission in Dubai based on internal communications from the ministries, on December 6 Dubai Afaq Ahmed, Deputy Head of Mission of the Pakistani Embassy, sent an email message to the Pakistan Foreign Ministry office in Islamabad, which was submitted to the court yesterday.

According to that email, the case received media attention when the host of the program Aaj Shahzeb Khanzada, Shahzeb Khanzada, conducted a 33-minute program on December 4, in which Mahim Amjad alleged that the extradition case The file has been tampered with and documents have been extracted from the file before submission, besides Mahim Amjad has been tweeting against State Life Insurance, Police, FIA, Judges and our mission.

In the email of the Pakistani embassy in Dubai, it is further written that 'the embassy has taken all steps to take forward the case of Taqi Haider Shah, as soon as we received the extradition file from the Ministry of Foreign Affairs, we placed it before the authorities of the United Arab Emirates so that can consider it and in most extradition cases, the UAE sends them back for more documents and information, and on any query from the UAE, the embassy directs the Ministry of Foreign Affairs in consultation with the Ministry of Interior to resolve these irregularities. requests and in some cases it may take 4 to 5 months to get a response from both the countries.

The above text is part of the embassy's email sent to the Foreign Ministry office in Islamabad, but the email does not specify what the embassy needs to do to clear simple objections to an extradition file. After all, how much time is required because this matter is pending for the last 11 months only because the United Arab Emirates feels that till date the complete certified documents for the extradition of the accused have not arrived from Pakistan.

In January 2023, the authorities of Dubai requested the extradition file from the Pakistani authorities, on which no progress has been made till date, and now the Ministry of Foreign Affairs of Pakistan is of the opinion that the United Arab Emirates has rejected the request and reminders submitted by Pakistan since September 2023. No response has been given.

On the other hand, Mahim Amjad, the daughter of the deceased, while reacting to the embassy's message, has told us that 'I have not posted anything on social media against FIA and judges, but apart from that, whatever I have posted against Jin Jin. There is solid evidence behind it which has also been shared with media houses.
