Former Chief Justice objected to the presence of Justice Tariq Masood in the bench in the military courts case

Former Chief Justice Jawad S. Khawaja raised an objection to the presence of Justice Sardar Tariq Masood in the bench on the issue of appeals against the trial of civilians in military courts in the Supreme Court.


Former Chief Justice Jawad S Khawaja has filed a petition in the Supreme Court and has taken the stand that Justice Sardar Tariq Masood has given his opinion in a note on the petitions related to military courts, so he should leave the bench.


The former chief has appealed that the matter should be sent to the Judges Committee for the formation of a new bench on the appeal related to the annulment of the trials of civilians in military courts.


They say that the Supreme Court constituted a 9-member bench on military courts, of which Justice Faiz Isa and Justice Sardar Tariq excused themselves from hearing the case. Sardar Tariq expressed his opinion in a note signed on June 26 In he declared the petitions of civilians against the military courts as inadmissible and said that the law should first be challenged in the High Court.


The position of the former Chief Justice is that Justice Sardar Tariq's hearing of appeals related to military courts is against the principles of justice, so the bench headed by him should be prevented from deciding on intra-court appeals.
