Peshawar: Senior lawyers and legal experts of the Supreme Court say that a constitutional crisis is visible after the death of caretaker chief minister, there is no law for the appointment of a new chief minister.


Talking to Geo News, legal expert Babar Khan Yousafzai said that with the death of caretaker chief minister, the provincial cabinet has been dissolved and the powers have gone to the governor.


Babar Khan Yousafzai said that there is a law for the election of a new chief minister on the death of an elected chief minister, but there is no law for the appointment of a new chief minister on the death of a caretaker chief minister. The new chief minister and cabinet will have to approach the court.


Constitution is silent in case of death of Caretaker Chief Minister: Legal expert Kazi Jawad


Senior jurist and Supreme Court lawyer Qazi Jawad Ehsan told Geo News that the Constitution is silent in the case of the caretaker chief minister's death, Article 224 is for appointing a caretaker government after the departure of the elected government. There is no law for the caretaker government but There is also no prohibition in Article 224.


Qazi Jawad said that to fill this gap, the Governor and the Election Commission should select the Acting Chief Minister, later the former Chief Minister and the opposition leader can select a new supervisory cabinet.


He said that it is necessary to elect an Acting Chief Minister immediately to run the important affairs of the province.


It may be noted that Caretaker Chief Minister Khyber Pakhtunkhwa Azam Khan passed away today after a brief illness, he was shifted to the hospital yesterday due to ill health.
